Terms of Use
1. General
These Terms of Use include the general terms for the use of the website available at ta.fi maintained by TA-Yhtymä Oy and Maapohjola Oy (on behalf of all subsidiaries of the TA-Yhtymä and Maapohjola Groups, hereinafter referred to as “TA”), and the user undertakes to comply with these terms when using the website and services.
At any time, TA has the right, without the need to give notice, to change the content and availability of the website and services or to end the publication of the website and the provision of the services on the website, either temporarily or definitively. TA also has the right to change these Terms of Use at any time.
The user is responsible for ensuring that the use of the website and services is in compliance with the legislation and fair practice and does not cause harm or stress to the website or TA. TA has the right to interrupt or prevent any use of the website or services that causes harm or stress to the website or TA without delay or the need to give notice.
2. Intellectual property rights
All materials published on the website and services, such as texts, graphics, logos, icons, images and illustrations as well as audio recordings and software, are the property of TA, its content producer, other subcontractor or supplier. These materials are protected by the copyright legislation in Finland and other countries. All intellectual property rights are the property of the respective party that created the content.
It is prohibited to present, reproduce, copy, transfer, relay, save, alter, distribute, publish, reuse, license, sell or otherwise utilise any content published on the website or the services for commercial purposes without the prior written consent of the copyright owner, TA or its co-operation partner. However, it is permitted to save or copy the materials for personal and non-commercial use. All intellectual property rights pertaining to the material remain with their original owner. Press releases and other public documents may be published by the media, provided that the source is mentioned.
3. Submission of materials
By sending materials (e.g. information, feedback, photos, questions, ideas, orders) to TA, for example by email or via the TA website, the user agrees and confirms that they have the right to send the materials to TA to be freely used without separate reimbursement to the sender or a third party. The user also confirms that the material sent is not illegal, threatening, insulting, inciting ethnic or racial hatred, pornographic, infringing religious beliefs, violating intellectual property rights, contrary to public morality or otherwise unsuitable for publishing. Furthermore, the user confirms that, prior to uploading the material, they have carried out reasonable measures to find and eliminate any viruses and other detrimental elements potentially contained within the material and that TA has the irrevocable right to publish the material cost-free and use it or any idea, concept, skill or technique contained therein for any purpose without providing separate reimbursement, any restrictions on use, mentioning the source or any pecuniary obligation or liability. The user undertakes to reimburse TA for any costs and damage incurred as a result of legal action instituted by any party against TA with regard to the material submitted. TA has the right to dispose of material submitted by users at any time. TA does not assume any responsibility or liability for any material submitted to its servers.
4. Limit of liability
The website content is provided “as is” and “as available.” TA does not assume responsibility for the availability, accuracy or reliability of the website or service, and TA is not liable for any direct, indirect, incidental, unexpected, special, instantaneous or consequential damage, lost profits or for business interruption arising out of the service offered on its website or the interruption of its provision or the information and materials contained on the website, even if TA has been advised of such damage.
The website and services may contain links to websites maintained by third parties and the services provided through these websites. Such links are services exclusively offered to the users, and TA does not assume any responsibility for such sites, their content or the accuracy of the content or the legality of the processing of personal data collected on these websites. When moving to such third-party sites, the terms and conditions of the site in question become applicable.
The user is responsible for the confidentiality of any user-specific username required to access the service on the website as well as the usage of the website with the password. TA does not assume any responsibility for issues and damage resulting from the user’s negligent storage of the password and username or from unauthorised use of the password and username. The user is liable to TA and directly to other parties for any possible irregularities and illegal and non-conforming actions. TA does not guarantee that the website is free of viruses or other malware or detrimental elements. The floor plans presented on the website are indicative and do not reflect the actual scale. TA reserves the right to change the information and apartment prices presented on the website.
5. Data privacy
The website may contain services that require the processing of personal data. Personal data may be used e.g. for the purpose of preparing and concluding an agreement, management of a client relationship, client satisfaction surveys and other surveys as well as client communications and direct marketing. 6. Cookies
Information about the user’s device is collected on the website with the use of cookies and other similar technologies. Cookies are small text files stored on the user’s device by the browser. Cookies contain an anonymous, unique identifier with which different browsers visiting the site can be identified and calculated. Cookies are used in a way that does not infringe the privacy of the website user. Users cannot be identified solely on the basis of cookies. Cookies do not allow access to or the possibility to copy the data storage device of the device, such as the hard drive.
Cookies allow for collecting information about when and how the services of TA are used: for example, what website the user used to access the service, what the user has browsed on the website and at what time, the browser used, the resolution of the display and the operating system of the device and its version. The website occasionally contains tracking pixels that are used for the purpose of setting cookies and user monitoring. In addition, the website occasionally contains the tracking pixels of TA’s partners, which are loaded from the partners’ servers. Tracking pixels are used for the purpose of advertising and marketing. The tracking pixels provided by third parties may track the user’s online behaviour on other websites beyond the TA website.
Cookies and other similar technologies are used for the purpose of monitoring the number of users of services and targeting advertising and measuring its impact. Furthermore, the use of cookies may affect the accessibility of the website.
